PETITION FOR ANTICIPATORY BAIL Under Sec.482 of BNSS PRAYER :- For Anticipatory Bail in Cr.No.16 of 2024 on the file of the respondent police.

ORDER : The Court made the following order :- The petitioners/Accused, who apprehend arrest at the hands of the respondent police for the offences punishable under Section 174 of Cr.P.C, in Crime No.16 of 2024, seek anticipatory bail.

2. The case of the prosecution is that the marriage between the 1st petitioner and the defacto complainant's daughter. Later, there was a matrimonial dispute between them. Therefore, 1st petitioner left her matrimonial home and resided at her parental home. It is also alleged that the 1st petitioner is in inebriated condition with his wife. 1st petitioner' wife contacted the defacto complainant over phone stating that her husband made quarrel with her under the influence of alhocol. When the defacto complainant tried to contact her daughter over phone, there was no answer and he immediately went his house and knocked the door. There is no answer. Immediately, he went top of the house and saw that 2/6

her daughter hanging in a nylon rope and died. Hence, the case.

3. The learned Counsel for the petitioners would submit that the petitioners are innocent persons and they have never committed in this case. Hence, he seeks anticipatory bail to the petitioners.

4. The learned Government Advocate (Criminal Side) submitted that the investigation is still in progress.

5. This Court has already granted interim anticipatory bail to the 1st petitioner and anticipatory bail to the 2nd, 3rd and 4th petitioners.

Taking into consideration the facts and circumstances of the case and since the first petitioner has complied with the condition imposed in the interim anticipatory bail regularly, the interim anticipatory bail already granted is made absolute and this Court is inclined to grant anticipatory bail to the first petitioner with certain conditions.

Accordingly, this Petition is allowed and the first petitioner is ordered to be released on bail in the event of arrest or his appearance, within a period of fifteen days from the date of receipt of a copy of this order, before the learned Judicial Magistrate, Palani, Dindigul District, on condition that the petitioners shall execute a bond for a sum of Rs.10,000/-(Rupees Ten Thousand only) each with two sureties, each for a like sum to the satisfaction of the respondent Police or to the Police Officer, who intends to arrest or to the satisfaction of the learned Magistrate concerned and on further conditions that: (a) the first petitioner and the sureties shall affix their photographs and left thumb impression in the surety bond and the Magistrate may obtain a copy of their Aadhar card or Bank pass Book to ensure their identity;

(b) the first petitioner shall report before the respondent police daily at 10.30 a.m until further orders. He has to co-operate for the investigation;

(c) the first petitioner shall not tamper with evidence or witness either during investigation or trial; (d) the first petitioner shall not abscond either during 4/6

investigation or trial;

(e) on breach of any of the aforesaid conditions, the learned Magistrate/ Trial Court is entitled to take appropriate action against the first petitioner in accordance with law as if the conditions have been imposed and the first petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji Vs. State of Kerala [(2005) AIR SCW 5560]; and;

(f) if the accused thereafter abscond, a fresh FIR can be registered under Section 269 of BNS 2023.
