ORDER
This writ petition has been filed seeking a direction to the respondents to sanction and disburse all retirement benefits, including the monthly pension along with arrears, with interest at the rate of 18% per annum for the delayed payment, in accordance with the petitioner's representation dated 12.06.2025.
2. According to the petitioner, he joined the services as a 'Laboratory Attender' on 22.07.1983 at Government Higher Secondary School, Arumanai. In accordance with G.O.Ms.No.537, dated 29.06.1994, the petitioner's post was upgraded from 'Laboratory Attender' to 'Laboratory Assistant'. Later, the petitioner was promoted to 'Desk Superintendent' on 03.01.2016 and subsequently, posted as a regular Superintendent at Nanguneri Block Education
Office on 01.08.2020. After rendering 41 years of continuous and unblemished service, the petitioner was permitted to retire on 31.07.2024, having attained the age of superannuation, with no disciplinary proceedings pending against him. Despite the petitioner's retirement and eligibility for retirement benefits, the respondents have failed to settle his entitlements, including the pension and terminal benefits. The petitioner is entitled to receive interest on the delayed payment of terminal benefits and pension arrears at the rate of 18% per annum. The petitioner submitted a detailed representation to the respondents on 12.06.2025, requesting disbursement of his retirement benefits, but the respondents have not addressed the issue. Hence, the present Writ Petition.
3. The learned Standing Counsel appearing for the first respondent submits that the first respondent has already seized of the matter and that appropriate orders will be passed in the case of the petitioner, within a period of one month from the date of receipt of a copy of this order.
4. Recording the above said submissions, this Writ Petition is disposed of with a direction to the first respondent to consider the petitioner's case on its own
merits and pass appropriate orders in accordance with law, after affording due opportunity to the petitioner, within a period of one month from the date of receipt of a copy of this order. It is also made clear that this Court has not expressed any of its views with regard to the merits of the matter and that it is open to the first respondent to consider the same on its own merits. There shall be no order as to costs. Consequently, connected Miscellaneous Petition is closed.
