For Respondent : Mr.P.Kottai Chamy, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory bail in Crime.No. 200 of 2021 on the file of the Respondent Police ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 294(b), 307 and 506(ii) of IPC @ 120(b), 147, 148, 149, 341, 294(b), 302 and 506(ii) of IPC in Crime No.200 of 2021, seeks anticipatory bail.

2. The case of the prosecution is that due to previous enmity, the accused attacked the defacto complainant with aruval. Hence, the complaint.

3. The learned counsel appearing for the petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in this case.

4. Heard the learned Government Advocate (Criminal Side) appearing for the respondent Police.

5. It appears that this is the second application for anticipatory bail and the earlier anticipatory bail application filed by this petitioner in Crl.O.P(MD).No.9414 of 2021 was dismissed on 15.07.2021 on the ground that the petitioner is having eighteen previous cases in (i) Crime Nos.233 of 2000, 279 of 2003, 1275 of 2004, 361 of 2005, 524 of 2006, 587 of 2000, 773 of 2008, 512 of 2009, 239 of 2012, 311 of 2012, 751 of 2013, 800 of 2013, 922 of 2015, 50 of 2016, 196 of 2017, 1167 of 2020 of Kovilpatti West Police Station, (ii) Crime No.570 of 2014 of Tirunelveli District Junction Police Station, (iii) Crime No.514 of 2014 of Tirunelveli District Town Police Station. Now, this application is filed by the petitioner without referring the change of circumstances to consider the case.

6. Since there is no change of circumstance and considering the antecedents of the petitioner, this Court is not inclined to entertain this Criminal Original Petition and the same is accordingly dismissed.
