The petitioner has filed this Writ Petition for the issuance of a Writ of Mandamus, directing the respondents to consider the petitioner's Page No. 1 of 5
application dated 18.03.2025, submitted to the first respondent, for making changes in the birth certificate, within a time frame to be fixed by this Court.
2. It is submitted by the learned Standing Counsel for the respondents that the application filed by the petitioner on 18.03.2025 has not been received by the first respondent. It is further submitted that alteration of the name in the birth register cannot be made in view of the restrictions under Section 15 of the Registration of Births and Deaths Act, 1969.
3. It is noticed that the petitioner in the application dated 18.03.2025 prayed for alteration in the names of the petitioner, her husband and her son by adding the names of their father with their name already in the register of birth and birth certificate, as detailed below: Party The present name To be changed The petitioner Parveen Banu Parveen Banu Bismillah Khan The petitioner's husband Bathrutheen Bathrutheen Hibbathul Rahman The petitioner's son Zishan Rahman Zishan Rahman Bathrutheen Page No. 2 of 5

4. It is submitted that these corrections are required to enable the petitioner, her husband, and her son to obtain a visa, as per the prevailing guidelines in Mexico.
5. Section 15 of the Registration of Births and Deaths Act, 1969, contemplates correction or cancellation of entries in the register of births and deaths.
6. Since the petitioner, her husband, and her son have to travel to Mexico, and the visa requirements mandate that the names of their respective fathers be included in the birth certificates, I see no impediment in directing suitable changes/alterations in the birth register and the birth certificates of the petitioner, her husband, and her son. Since the earlier application has not reportedly been received, the petitioner is directed to submit a fresh application, along with the relevant supporting documents, within a period of 15 days from the date of receipt of a copy of this order. 7. In any case, if such an application is filed by the petitioner, the same shall be duly scrutinized, and appropriate changes shall be effected forthwith to meet the requirements of the provisions of the Registration of Births and Deaths Act, 1969.
