2. The detenue is the petitioner. He was detained as "Goonda" vide order dated 16.05.2024. Representation dated 09.07.2024 was submitted seeking revocation of the detention order.
3. The ASO dealt with the file on 18.07.2024. However, the Hon'ble Deputy Secretary dealt with the file on 26.07.2024. We notice that there is an unexplained delay of five days in considering the representation. The delay of five days in considering the representation is fatal to the continuance of the detention. 2/5
4.In this view of the matter, we hold that the detenue's continued detention is illegal. He shall be set at liberty forthwith unless his detention is otherwise warranted by law.
