Prayer : Criminal Original Petition filed under Section 528 of BNSS, to call for records in CC No.1482 of 2024, on the file of the Judicial Magistrate Court No.I, Madurai and to quash the same as illegal and as against this petitioner.

O R D E R

The petitioner has approached this Court to quash the proceedings in CC No.1482 of 2024, on the file of the Judicial Magistrate Court No.I, Madurai.

2.It is a case of job racketing. The petitioner along with three other accused, on the assurance of arranging jobs has received a sum of Rs.42,14,000/- from various persons and cheated them. 3.The learned counsel for the petitioner submits that this petitioner is A2 and the wife of A1. He further submits that there is a matrimonial dispute between this petitioner and A1 for a considerable period, even prior to the alleged transactions. He further submits that OP.No.600 of 2023 is pending before the Family Court, Tiruppur. The petitioner has been wrongly implicated in this case and therefore, the proceedings in CC No.1482 of 2024 has to be quashed as against this petitioner.

4.Mr.A.S.Abul Kalaam Azad, learned Government Advocate (Crl.side) who takes notice for the first respondent strongly objects for quashing the proceedings in CC No. 1482 of 2024 that the petitioner's involvement in the commission of offence has been substantiated by the prosecution. 5.Heard the learned counsel appearing for the petitioner and the learned Government Advocate (Crl. side) appearing for the respondent.

6.Though the petitioners have raised several grounds, this Court is of the opinion that it can be appreciated only during the trial. Therefore, this Court is not inclined to entertain this petition at this stage and accordingly, this Criminal Original Petition is dismissed. However, liberty is granted to the petitioner to raise all these grounds before the trial Court, during trial.
