2. Learned counsel for the respondent would submit that the petitioner has come up with the proposal of settlement and he has no objection in the delay being condoned and the appeal being numbered.

3. Being satisfied with the reasons stated in the supporting affidavit, delay is condoned and this petition is allowed.
