Prayer : Criminal Original Petition filed under Section 528 of Bharatiya Nagarik Suraksha Sanhita, to allow this petition and withdraw the case in SC.No.176 of 2016 on the file of the Chief Judicial Magistrate, Sivagangai and transfer the same to any other district for further proceedings.

ORDER

The petitioners accused in SC.No.176 of 2013 on the file of the learned Chief Judicial Magistrate, Sivagangai have approached this court to transfer the said case to some other court. 2.The learned Counsel for the petitioners submits that the case in SC.No.176 of 2013 is pending without any progress for years together and therefore, he seeks to transfer the case to some other court. 3.The learned Additional Public Prosecutor appearing for the respondent police submits the case is not progressed only on account of the petitioners. The petitioners had filed a petition to discharge them from the charges and it was dismissed. Challenging the same they had filed a revision case before this court in CrlRC No.1415 of 2024 and it is pending.

4.Recording the aforesaid submission of the learned Additional Public Prosecutor that the criminal revision case filed by the petitioners as against the dismissal of the discharge petition is pending before this 2/4

Court and in view of the same, the the trial has not proceeded, this petition is dismissed. Consequently connected miscellaneous petition is also dismissed.
