PRAYER: Criminal Original Petition is filed under Section 528 of BNSS Act, to direct the 1st respondent to transfer the investigation of the case in Cr.No.194 of 2025, on the file of the 2nd respondent police station to any other competent person, consequently direct him to file a final report before the concerned Court within the time stipulated by this Court in the light of the order passed in Crl.M.P.No.1322 of dated 10.04.2026.

ORDER

The present petition has been filed by the defacto complainant in Crime No.194 of 2025, on the file of the second respondent police seeking a direction to file a final report before the concerned Court in the light of the order passed in Crl.M.P.No.1322 of 2025, dated 10.04.2026. 2.The second respondent police have filed a charge sheet in the above said matter before the learned Judicial Magistrate, Eraniel. By way of an order dated 10.04.2026, the learned Judicial Magistrate was pleased to direct further investigation by another Inspector of Police.

3. The grievance of the petitioner is that the same police officer is again calling the petitioner for further enquiry and the transfer of investigation is not taking place as per the orders of the learned Judicial Magistrate.

4. Per contra, the learned Counsel for State of TN(crl.side) appearing for the respondents 1 and 2, submitted that Mr.Shiek Abdul Kadar, Inspector of 2/5

Police, Colachel, has been appointed as the Investigating Officer by the orders of Deputy Superintendent of Police, Colachel Range and he would continue with the investigation and file a supplementary charge sheet on or before 31.07.2026.

5. In such view of the matter, no further orders are called for. Accordingly, this Criminal Original Petition stands disposed of. 12.06.2026 NCC : Yes/No Index : Yes/No Internet: Yes/No RJR 3/5
