Writ Petition is filed under Article 226 of the Constitution of India, praying this Court To issue a Writ of Mandamus to direct the respondents to grant permission to conduct Mulaipari festival and other annual festivals in the village Temple Arulmigu Thiruvadi Ayyanar and Arulmigu Uyyavantha Amman Temple at Melakidaram Village, Kadaladi Taluk, Ramanathapuram District scheduled on 07.10.2018 to 17.10.2018 based on the representations dated 05.09.2018.

JUDGMENT

(Judgment of the Court was delivered by HULUVADI G.RAMESH,J.) Heard the learned counsel for the appellant and Mrs.J.Padmaavathi Devi, learned Special Government Pleader, who takes notice for the respondents 1 to 5.

2. This writ appeal is directed as against the order, dated 25.09.2018 passed in W.P(MD)No.19964 of 2018.

3. It appears that the order of the learned Single Judge is to facilitate for the conduct of the Village festival, namely "Mulipari Festival". It also appears that there are two factions. Already the said festival was scheduled to be held in the beginning of October, 2018, ie., 07.10.2018 to 17.10.2018 and the said period is lapsed. However, the parties are intending to celebrate the said festival on the subsequent dates.

4. In such view of the matter, the parties are directed to make a fresh application before the concerned authority, who shall take care of the situation. If there is any disturbance, it is for the concerned authority to conduct the Peace Committee Meeting for peaceful conduct of the said festival.

5. This Writ Appeal is ordered accordingly. No costs. Sd/- Assistant Registrar(AS) /True Copy/ Sub Assistant Registrar(CS-IV)
