PETITION FOR MODIFICATION Under Sec.528 of BNSS PRAYER :- To modify the condition No.7(vi) imposed in Crl.OP(MD).No.8096 of 2025 dated 30.04.2025.
ORDER : The Court Made the following order :- This petition has been filed to modify the condition No.7(vi) imposed in Crl.OP(MD).No.8096 of 2025 dated 30.04.2025.
2. The learned counsel for the petitioners would submit that the petitioners have filed an anticipatory bail application before this Court on 28.04.2025 in Crl.OP. (MD).No.8096 of 2025. The said anticipatory bail petition was heard and on 08.05.2025, this Hon'ble Court was pleased to grant anticipatory bail to the petitioners with certain conditions. In the said anticipatory bail order, Para.7(vi) is as follows:
''(b). The petitioners shall stay at Dindigul District and appear and sign before the Dindigul Town Police Station, Dindigul, daily at 10.00a.m. until further orders.''
3. He further submits that the petitioners belongs to Theni District District and in the said order this Hon'ble Court imposed condition that the petitioners shall appear and sign before the Dindigul Town Police Station. But, there are North and South Police Stations are situated in Dindigul Town Limit. Due to ambiguity regarding the Dindigul Town Police Station as there are both Dindigul North and 2/4
South police stations within the town limits. The petitioners have faced difficulty in complying the said condition. Hence, the petitioners seek indulgence of this court by modifying the said condition imposed against them. Hence, he prays for modification of the said condition.
4. The learned Government Advocate (Crl.side) appearing for the respondent has not raised any objection to allow this Criminal Miscellaneous Petition.
5. Considering the submissions made by the learned Counsel for the Petitioners and being satisfied with the reasons stated above, this Court is inclined to modify the Condition No.7(vi) in the order made in Crl.O.P(MD).No.8096 of 2025 dated 30.04.2025. Accordingly, Condition No.7(vi) is modified as ''(vi). The petitioners shall appear and sign before the Inspector of Police, Bodinayakkanur Rural Police Station, Theni District, daily at 10.30a.m., until further orders.''. The other conditions shall remain unaltered.
