ORDER

This petition has been filed seeking for a direction to the respondent no.2 to transfer the investigation in crime no.79 of 2026 dated 03.03.2026 registered under Section 194(1) of BNSS on the file of respondent no.3 to the respondent no.4 for investigation and filed a final report by considering the petitioner's representation dated 27.04.2026 within the time stipulated by this Court.

2. The learned counsel appearing for the petitioner submitted that the petitioner has three sisters, of whom one Kamatchiyammal was the youngest. On 03.03.2026, at about 06.30 a.m., the petitioner received information that the body of a girl was found floating in the agricultural well belonging to his family, situated near the road leading from Periya Mallanampatti to Kothampatti Village. Upon receiving the information, the petitioner and his father immediately rushed to the spot and were shocked to find that the body was that of the petitioner's younger sister, Kamatchiyammal. 2/6

3. It was further submitted that, suspecting foul play in the death of Kamatchiyammal, a complaint was lodged before the respondent police. Pursuant thereto, the body was recovered from the well and subjected to postmortem examination. Thereafter, a case in Crime No.79 of 2026, dated 03.03.2026, came to be registered under Section 194(1) of the BNSS treating the occurrence as a suspicious death.

4. According to the petitioner, no substantial progress has been made in the investigation. Therefore, the petitioner submitted a representation to the respondent police seeking transfer of the investigation from the file of the 3rd respondent to that of the 4th respondent. Since the said representation has not been considered, the petitioner has approached this Court by filing the present writ petition.

5. The learned Government Advocate appearing for the respondent police submitted that, as per the post-mortem report, the cause of death was asphyxia due to drowning. It was further submitted that the deceased had died on account of drowning in water and that no significant external injuries were found on the body, except for certain abrasions on the face. The learned Government Advocate further submitted that the investigation is at the final stage and is 3/6

almost complete, and that the final report would be filed before the jurisdictional Court within a short period of time. Therefore, it was contended that there is no necessity to transfer the investigation, as the 3rd respondent police is conducting the investigation in a fair and proper manner. On the said grounds, he sought for dismissal of this petition.

6. Heard the learned counsel on either sides and carefully perused the materials placed before this Court.

7. Considering the fact that the victim is a young minor girl, the second respondent is directed to monitor the ongoing investigation conducted by the 3rd respondent from time to time, and the 3rd respondent is directed to appraise the progress in the investigation to the second respondent every Friday.

8. With the above directions, the writ petition stands disposed of. 09.06.2026 NCC : Yes / No Index : Yes / No sm 4/6
