PRAYER : Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Certiorarified Mandamus, to call for the records pertaining to the impugned Refusal Check Slip No.RFL/Thiruverumbur/304/2024 dated 03.12.2024 issued by the respondent and quash the same as illegal and consequently direct the respondent to entertain the sale deed dated 03.12.2024 presented by the petitioner for registrtion and register the same in accordance with law.

ORDER

The present Writ Petition has been filed for issuance of a Writ of Certiorarified Mandamus to quash the impugned refusal check slip dated 03.12.2024 and consequently direct the respondent to entertain the sale deed dated 03.12.2024.

2. The respondent, through the impugned order, has directed the petitioner to produce the original parent document.

3. The contention of the petitioner is that the said parent document is not available with him. Moreover, the parent document is not necessary for registering the case in accordance with law.

4. This Court accepts the contention of the petitioner. This Court has already passed several judgments holding that the respondent cannot insist on the production of the original or parent document at the time of registration. The role of the respondent is limited to identifying the parties and registering the document.

5. Therefore, the impugned refusal check slip dated 03.12.2024 is hereby quashed. The respondent is directed to register the sale deed within a period of four weeks from the date of receipt of a copy of the order.

6. With these observations, this writ petition is allowed. No Costs. 25.06.2025 NCC : Yes / No Index : Yes / No Internet : Yes KSA To The Sub-Registrar, Thiruverumbur Sub Registrar Office, Trichy District.
