ORDER

This Writ Petition is disposed of at the time of admission after hearing the learned counsel for the petitioner, learned Central Government Standing Counsel for the first respondent and learned Government Advocate (Crl.Side) for the second respondent.

2. The petitioner is an Accused No.2 before the learned Judicial MagistrateII, Sivagangai in C.C.No.232 of 2024, pursuant to the FIR registered before the second respondent in Crime No.19 of 2022, for the offences under Sections 406, 468, 471, 420 and 109 of IPC.

3. The petitioner has been issued with Show Cause Notice, dated 30.09.2024, wherein certain clarifications called for from the petitioner. The petitioner had, however, not replied to the same.

4. It is informed by the learned counsel for the petitioner that at that stage, the case was at the stage of investigation before the second respondent, only thereafter, the above case was taken on file by the learned Judicial Magistrate-II, 2/4

Sivagangai in C.C.No.232 of 2024.

5. Since the case is now pending before the learned Judicial Magistrate-II, Sivagangai, the prayer of the petitioner for issuance of the passport cannot be considered.

6. However, it is open for the petitioner to move the said Magistrate Court for suitable orders for the first respondent to process the passport application.
