The petitioner has come to this Court seeking for a Mandamus to direct the respondents 1 to 3 to consider and pass orders forthwith on the petitioner's representation, dated 24.06.2019.
2. The case of the petitioner is that, he is one of the members (Member No.3641) of the Co-operative Society namely, the Aralvaimozhi Primary Agriculture Co-operative Credit Society. The fourth respondent is also a member of the said Society and he was elected as President of the Society on 13.08.2018 and has been holding the said post till date. The grievance of the petitioner is that the fourth respondent is running a private finance company in the name and style of 'Balaji Finance' (License No.02/2017) at Anna Bus stand, Nagercoil, which is a private money lending business, without the knowledge of the other respondents and it is also in violation of Tamil Nadu Co-operative Societies Act, 1983 and the Rules and Bye-laws.
3. In this regard, the petitioner submitted a representation, dated 24.06.2019 to the respondents 1 to 3 regarding the violation of the Act and Rules committed by the fourth respondent and requested to take appropriate action against him. However, the respondents 1 to 3 have not come forward to take action upon the representation submitted by the petitioner. Aggrieved over the same, the petitioner has approached this Court by way of filing the present writ petition seeking for a direction to the respondents to consider his representation, dated 24.06.2019.
4. In view of the submissions made by the learned counsel appearing for the petitioner, this Court, without going into the merits of the case, directs the respondents 1 to 3 to consider the representation of the petitioner, dated 24.06.2019 on merits and pass appropriate orders in accordance with law within a period of four weeks from the date of passing of this order.
5. With the above directions, the Writ Petition stands disposed of. No costs. List the matter on 25.02.2020 'for reporting compliance'.
