This writ petition has been filed by the petitioner for issuance of a writ of Mandamus, directing the third respondent to dispose of the original application pending in O.Mu.NA.No.50072/2016, dated 12.12.2016, preferred as per G.O.Ms.No.385, dated 17.08.2004, with regard to rectifying the defects in Updating Register (UDR), in respect of property situated in T.S.No.42, Ward-D, Block No.34, Puliangudi Municipality, Tirunelveli District, within a stipulated time. https://hcservices.ecourts.gov.in/hcservices/
2.The learned Government Advocate takes notice for the respondents. By consent, the writ petition itself is taken up for final disposal.
3.The learned counsel for the petitioner submitted that though the petitioner has filed original application in O.Mu.NA.No.50072/2016, as early as on 12.12.2016, as per G.O.Ms.No.385, dated 17.08.2004, for rectifying the defects in Updating Register (UDR), in respect of property situated at T.S.No.42, Ward-D, Block No.34, Puliangudi Municipality, Tirunelveli District, till date the third respondent did not take any steps to dispose of the same. Hence, the third respondent may be directed to dispose of the said application within a stipulated time.
4. The learned Government Advocate appearing on behalf of the respondents have no objection for such an order being passed by this Court.
5. In view of the averments made in the affidavit filed in support of this Writ Petition and in view of the submissions made by the learned counsel appearing on behalf of the parties, the third respondent is directed to consider and dispose of the application of the petitioner pending in O.Mu.NA.No.50072/2016, dated 12.12.2016, on merits and in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order, after affording sufficient opportunity to the petitioner as well as the other interested persons, if any.
6. The Writ Petition stands disposed of with the above directions. No costs.
