Respondent Prayer: Writ Petition is filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus directing the respondent herein to issue the separate patta in favour of the petitioner in respect of the land comprised in Survey No.129/2 situated at Siruthayur Village, Lalgudi Taluk to an extent of 9 cents in petitioner's name basing on his representation dated 18.02.2016 within the time stipulated by this Hon'ble court.

ORDER

The petitioner has filed this Writ Petition seeking a direction, directing the respondent herein to issue separate patta in his favour in respect of the land comprised in Survey No.129/2 situated at Siruthayur Village, Lalgudi Taluk to an extent of 9 cents in his name, on the basis of his representation dated 18.02.2016.

2.According to the petitioner, he filed an application before the respondent on 24.04.2015 to survey his land and demarcate the boundaries and he has also paid necessary fees for the same. Pursuant to that, the respondent directed the Village Administrative Officer to make necessary enquiry and submit a report. Accordingly, the Village Administrative Officer also submitted a report on 29.04.2015. In spite of that, no action has been taken by the respondent. Hence, the petitioner has filed the present writ petition.

3.Heard the submissions made on either side and perused the documents carefully.

4.Considering the fact that the Village Administrative Officer already submitted a report on 29.04.2015 and even after that no action has been taken by the respondent herein, the respondent is are directed to conduct survey of petitioner's land in Survey No.129/2 situated at Siruthayur Village, Lalgudi Taluk along with the surveyor and pass orders, after issuing notice to the petitioner as well as rival claimants, with reference to the revenue records and the petitioner's title deeds, within a period of 12 weeks from the date of receipt of a copy of this order. 5.With the above direction, this writ petition is disposed of. There shall be no order as to costs.
