Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents to grant the Balance Expenses Amount of Rs. 3,24,414/- to the petitioner under the New Health Insurance Scheme for the Surgery of Anterior Cervical Discectomy and Fusion by considering his Hospital and Medical Bills and representation dated 21.03.2024 and for other such reliefs, within the period stipulated by this Court. Heard Mr.A.Haja Mohideen, learned counsel for the petitioner, Mr.J.Ashok, learned Additional Government Pleader appearing for the respondents 1 and 2 and A.Shajahan, learned Standing Counsel appearing for the third respondent.

2. By consent of both parties, this writ petition is taken up for final disposal at the stage of admission itself.
3. The petitioner is a Government servant and he was suffered pain in his left arm and took treatment for Cervical Cord Stenosis disease in Hannah Joseph Hospital and he undergone surgery on 09.01.2024 in his back side of the neck and incurred a sum of Rs.5,61,064/- towards medical expenses. When he claimed the same, the third respondent insurance company has paid a sum of Rs.2,36,650/- only and the remaining amount had to be borne by him. Thereafter, the petitioner given a detailed representation dated 21.03.2024 to the respondents seeking the balance and the same has not been considered so far. Hence, the petitioner has filed this writ petition.
4. The learned Additional Government Pleader appearing for the respondents submitted that the representation of the petitioner is pending before respondents and the same would be considered by the respondents within a time frame fixed by this Court. 3/6

In view of the above submission, this Writ Petition is disposed of and the respondents herein are directed to consider the petitioner's representation, dated 21.03.2024 on its own merits and pass appropriate orders in accordance with law, within a period of four weeks from the date of receipt of a copy of this order. It is made clear that this Court has not gone into the merits of the claim of the petitioner and it is open to the respondents to consider the same on its own merits. No costs.
