To prefer this Memorandum of Grounds of Civil Miscellaneous Appeal against the order made in W.C.No. 267 OF 2006, dated 02.12.2009, copy received on 05.03.2010, on the file of the Commissioner for Workmens Compensation, Deputy Commisioner of Labour, Dindigul.

ORDER : This petition coming on for orders upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Mr.S.SRINIVASA RAGHAVAN, Advocate for the petitioner and of Respondent 1 not appeared either in person or by an advocate, the court made the following order:- This petition is filed to condone the delay of 64 days in seeking to set aside the order dated 02.07.2018 made in M.P.(MD)No.2 of 2014 in C.M.A.(MD)No.31296 of 2010 as against the second respondent.

3.Considering the contention of the learned counsel for the petitioner, the delay of 64 days is condoned and this petition is ordered on payment of cost of Rs.500/- (Rupees Five Hundred Only) to the Rojavanam, Homeless & Aged Care Centre, Melur Road, Uthangudi, Madurai, on or before 23.10.2018, failing which, this petition shall stand dismissed automatically, without further reference to this Court.
