ORDER

This Writ Petition is disposed of at the time of admission after hearing the learned counsel for the petitioner and learned Standing Counsel for the respondents.

2. This Writ Petition has been filed by the petitioner to direct the respondents to provide Electricity connection to the petitioner's land in S.No. 840/8, Kamraj Nagar, Naranammalpuram, Tirunelveli District, based on petitioner's application, dated 25.11.2024 (Reference No.200070221124755).

The petitioner is the owner of the property, which the petitioner claims to have been settled in favour of the petitioner, pursuant to the settlement deed executed by the petitioner's brother vide registered Doc.No.38/24 dated 04.01.2024. Therefore, the petitioner has decided to put up a building after getting approval from the Town Panchayat Executive Officer in his proceedings dated 14.05.2024.

4. Under these circumstances, the petitioner has applied for electricity connection through the second respondent on 25.11.2024. However, the application has not been acted upon.

5. The learned Standing Counsel for the respondents submits that one of the neighbours, namely, Pushpakani, w/o. Chelladurai, is objecting the same.

Since the petitioner has decided to put up a construction on his patta land, which has been settled in favour of the petitioner, pursuant to the settlement deed dated 04.01.2024 in Doc.No.38/2024, I see no impediment in directing the respondents to provide electricity connection to the petitioner's construction purportedly pursuant to the approval given by the Town Panchayat Executive Officer, in his proceedings, dated 14.05.2024. Therefore, the respondents are directed to give electricity connection to the petitioner as expeditiously as possible preferably within a period of four (4) weeks from the date of receipt of a copy of this order. This direction is without prejudice to the rights of said Pushpakani, in case she secures a favour decree/order from a Civil Court. 3/5
