Prayer : Criminal Original Petition filed under Section 528 of BNSS, to direct the second respondent not to interfere in the business activities of the petitioners in procuring and selling Gloriosa Superba seeds (Senganthal flower seeds) and not to harass the petitioners or his men and staffs under the guise of enquiry.

The petitioners with a grievance that in their business 1/4

transaction, the respondent police are unnecessarily harassing them, have approached this Court.

2.Mr.P.Kottaichamy, learned Government Advocate (Crl.side) takes notice for the respondents 1 & 2 and submits that one Selvakumar has lodged a complaint as against these petitioners that for the goods supplied by him worth Rs.47 Lakhs, the petitioners have not made payment. Therefore, the complaint of the said Selvakumar has been treated as a petition enquiry in CSR No.178 of 2025 on 11.06.2025 and the respondent police called the petitioners for enquiry.

3.Even according to the version of the respondent police, the allegation of the said Selvakumar as against the petitioners appears to be a dispute with regard to their business transactions. In the event, if the complaint constitute a cognizable offence, it is open to the respondent police to register a case. The respondent police is not supposed to interfere in a civil dispute and they are not supposed to be a collection agent.

4.In view of the above, this Criminal Original Petition is allowed. The respondent police shall not harass the petitioners. 23.06.2025 NCC : Yes/No Index : Yes/No Internet:Yes vrn To 1.The Superintendent of Police, Dindigul District, Dindigul.
