Writ Petition is filed under Article 226 of the Constitution of India to issue a Writ of Mandamus, directing the first and second respondents to consider and pass order on my representation dated 27.07.2016 for the removal of unauthorized encroachments put up by the third respondent in Vinayakar Kanmai located in S.F.No.597-2, within the time frame that may be stipulated by this Court.

O R D E R

*********** [Order of the Court was made by S.NAGAMUTHU, J.] The petitioner has come up with this Public Interest Litigation alleging that there are certain encroachments made by some persons belonging to leading political parties on the Kanmai land, known as 'Vinayakar Kanmai', comprised in S.F.No.597-2, Thirumayam Village in Pudukkottai District.

2. On instructions from the first and second respondents, the learned Government Advocate would submit that already the second respondent has requested the Tahsildar, Thirumayam, by his https://hcservices.ecourts.gov.in/hcservices/

proceedings in f.vz;.Nfh-3/c.ngh(jp)/2016, dated 21.09.2016, requesting him to measure the Kanmai land, so as to enable him to remove the encroachment. The learned Government Advocate would further submit that the said process will be completed, within a period of two months. The same is recorded.

3. In view of the above, the Writ Petition is disposed of with a direction to the first and second respondents to complete the measurement, within a period of two months from the date of receipt of a copy of this order and remove the encroachments, if any, after affording sufficient opportunity to the encroachers in accordance with law. No costs.
