The petitioner seeks for a direction to the respondent to consider and pass orders on the Appeal together with the Condone Delay Petition submitted by the petitioner on 13.10.2016 on merits and in accordance with the law.

2. Heard both sides.

3. It is seen that the said appeal with condone delay petition was filed by the petitioner challenging the order refusing to renew the gun license. Therefore, it is for the appellate authority to consider the condone delay petition first and if he is satisfied with the reasons stated in such petition, he can further take up the appeal and dispose the same on merits and in accordance with law.

4. Therefore, without expressing any view on the claim made by the petitioner, I only direct the respondent to consider the condone delay petition filed by the petitioner and pass appropriate orders on merits and in accordance with law within a period of 8 weeks from the date of receipt of copy of this order. If the delay is condoned by the respondent, the appeal shall also be disposed of on merits https://hcservices.ecourts.gov.in/hcservices/

and in accordance with law without loss of further time, however, within a period of twelve weeks Therafter.

5. With the above direction, this writ petition is disposed of. No costs.
