on 14.03.2025 for the offences punishable under Sections 8(c) r/w.20(b)(ii) (c), 23,25,27A,28 and 29 of NDPS Act in Crime No. 48/01/07/2025 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioner along with other accused were found in illegal possession of 445kgs of ganja. Hence, the case..

The learned counsel for the petitioner submits that the respondent police has registered a false case against the petitioner and he is not involved in any such activities as alleged by the respondent police. He would further submit that the petitioner has been arrested and remanded to judicial custody on 14.03.2025. Hence, he prays to grant bail to the petitioner.

4. The learned Special Public Prosecutor appearing for the respondent would submit that the petitioner along with other accused were found in illegal possession of 445kgs of ganja which is a commercial quantity. Hence, he opposed to grant bail to the petitioner. 2/4

5. This Court heard both sides and perused the materials available on record.

6. Considering the rival submissions on either side and that the contraband involved in this case is commercial quantity and the fact that the petitioner was present in the scene of occurrence at the time of recovery of contraband along with other accused and further petitioner has not satisfied the twin condition as per Section 37 of the NDPS Act hence this Court is not inclined to grant bail to the petitioner.

7. Hence the petition stands dismissed.
