ORDER

The appellant is accused No.4 in Crime No.422 of 2022 on the file of the respondent police, which was registered for the offence punishable under Sections 147, 148 & 302 IPC @ Sections 147, 148, 302 & 120-B IPC r/w Sections 3(2)(v) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act. He was arrested, remanded to judicial custody on 08.11.2022 and was enlarged on bail on 25.01.2023 by the learned I Additional District and Sessions Judge (PCR), Trichy Court. However, the appellant failed to appear before the trial court on 07.11.2023 and hence , a non-bailable warrant of arrest was issued as against him on the same day. The appellant was secured on the execution of warrant on 10.02.2026 and since then, this appellant is in jail. This is the second appeal filed by the appellant and the earlier appeal filed by the appellant was dismissed on 16.03.2026.

2.The learned counsel for the appellant submits that originally the appellant was enlarged on bail on 25.01.2023. Since no summon was served on 2/5

him after filing of the final report, he could not appear before the trial Court. Due to his employment at Karur, he was residing along with the victim there. 3.The learned Government Advocate submits that this appellant and accused No.4 are evading the trial. Though the final report was filed in the year 2023, the trial court is yet to commence. The accused No.4 is absconding, as against him NBW is pending and he is yet to be secured. Therefore, she opposes bail to the appellant.

4.This court considered the rival submissions made. 5.The appellant was granted bail on 25.01.2023 and due to his non appearance before the trial court on 07.11.2023, NBW was issued as against him and he was secured on 10.02.2023. It is reported that accused No.4 is absconding and therefore, the trial is not yet commenced. Since the trial itself is not commenced and accused no.4 is also absconding, this court is not inclined to entertain this appeal. Accordingly, this appeal is dismissed. 3/5
