PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus to call for the records pertaining to the tender notification issued by the 3rd respondent herein in Na.Ka.No. 272/2024/A1 dated 02.07.2024 and quash the same as illegal and further direct the respondents herein to permit the petitioner to collecting and disposing of garbage and waste from the kottaram 1st grade Panchayath for the financial year till March 2025.

ORDER

This writ petition has been filed challenging the tender notification issued by the 3rd respondent herein in Na.Ka.No.272/2024/A1 dated 02.07.2024 with a consequential direction to the respondents herein to permit the petitioner to collect and dispose of the garbage and waste from the kottaram 1st grade Panchayath, for the financial year till March 2025.

2. Heard the learned counsel on either side.

3. When the matter is taken up for hearing, the learned Additional Government Pleader appearing for the respondents 1 to 3 submits that the tender notification dated 02.07.2024 is proposed to be cancelled by the respondents and they will issue a fresh tender notification.

4. Since the respondents are proposed to cancel the tender notification, which is impugned in this writ petition, there is no occasion for the petitioner to agitate this writ petition. Accordingly, this writ petition is dismissed. There shall be no order as to costs. Consequently, connected miscellaneous petitions are closed.
