For Respondent : Public prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.23 of 2019 on the file of the respondent police ORDER : The Court Made the following order :- The petitioner apprehending arrest at the hands of the respondent police for the alleged offences punishable under Sections 406 and 420 of IPC, in Crime No.23 of 2019, seeks anticipatory bail. 2.Heard the learned counsel for the petitioner and the learned Government Advocate (Crl. Side) for the respondent. 3.The petitioner had collected a sum of Rs.7,38,000/- from the pions muslims by promising them to send them for Holy Haj Pilgrims. But the petitioner did not organise the event. 1/3
4.The petitioner's counsel states that the petitioner is ready to deposit the same and seeks two months time to deposit the said amount of Rs.7,38,000/- to the credit of Crime No.23 of 2019, on the file of the learned Judicial Magistrate No.V, Trichy, Trichy District.
5.Recording the undertaking given by the petitioner through his counsel, this Court is inclined to grant anticipatory bail to the petitioner with certain conditions. If the petitioner does not comply with this undertaking, the respondent is directed to file an application for cancellation of anticipatory bail. 6.Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate No.V, Trichy, Trichy District and on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police as and when required for interrogation. The petitioner shall comply with the conditions stipulated under Section 438 Cr.P.C. Scrupulously. 7.The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail shall stand dismissed.
