ORDER

The petitioner, who apprehends arrest at the hands of the respondent police for the offence punishable under Sections 192, 352 and 353(2) of BNS, 2023 in Crime No.92 of 2025 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that on 08.04.2025, based on information received by the respondent police, they checked the instagram account in the name of Smeer Smeer Pkl, it shows the reel which was shared in his profile contains videos and pictures of the petitioner along with dangerous weapon and had tag lines which may disrupt the peace and religious harmony in the society. Hence, the present case.

3.The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has not committed any offences as alleged by the prosecution. He further submitted that the petitioner is ready and willing to abide by any conditions which may be imposed by this Court. Hence, he seeks anticipatory bail to the petitioner.

4. The learned Government Advocate (Criminal Side) submitted that the investigation is at initial stage and if the petitioner is released on anticipatory bail, he may abscond. Hence, he opposed for grant of anticipatory bail to the petitioner.

5. Considering the facts and circumstances of the case and also the nature of the offence committed by the petitioner and the investigation is still pending, if the petitioner is released on anticipatory bail, he may tamper the witnesses and abscond. Hence, this Court is not inclined to grant anticipatory bail to the petitioner.

6.Accordingly, this criminal original petition stands dismissed.
