ORDER

This petition has been filed seeking for a direction to the 2nd respondent to take appropriate action on petitioner's complaint dated 09.05.2026 within a time frame as stipulated by this Court.

2. The learned counsel appearing for the petitioner submitted that the petitioner is a senior citizen and that he was subjected to physical and verbal abuse by the proposed accused, causing him considerable hardship and mental agony. In this regard, the petitioner lodged a complaint before the respondent police. However, no effective action was taken on the said complaint. Aggrieved by the inaction of the respondent police, the petitioner has filed the present petition.

3. The learned Government Advocate appearing for the respondent police submitted that the entire dispute has emanated from landlord-tenant dispute between the parties and that the matter is predominantly civil in nature. It was further submitted that a civil suit concerning the same subject matter is presently pending adjudication before the competent civil Court. 2/4

4. Heard the learned counsel on either sides and carefully perused the materials placed before this Court.

5. Considering the fact that the petitioner is a senior citizen, the second respondent police is directed to consider the petitioner's complaint dated 09.05.2026 and conduct an enquiry in this regard, after issuing summons to the parties concerned, under Section 64 of the BNSS, and ascertain whether the petitioner has been subjected to any physical harassment or injury, and conclude the enquiry in accordance with law, after affording an opportunity of hearing to all the parties concerned, within a period of four weeks from the date of receipt of a copy of this order.
