PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus, to call for the records of the impugned order in Na.Ka.No.1/2023, dated 23.05.2023 of the fourth respondent and quash the same as illegal and violation of Natural justice and directing the third respondent to reinstate the petitioner to his job in the office of the fourth respondent.

O R D E R

The instant Writ Petition has been filed by a Clerk, working in the fourth respondent Co-operative Society, challenging the order of suspension dated 23.05.2023.

2. The learned Additional Government Pleader appearing for the respondents 1 to 4 herein submits that the petitioner was issued with a charge memo on 16.04.2024 and the enquiry has been completed and it is placed before the third respondent for passing orders. 2/5

3. In view of the fact that the enquiry has been completed, at this length of time, the question of setting aside the order of suspension would not arise. The third respondent herein is directed to pass the final orders in the disciplinary proceedings, on or before 31.12.2024. The respondents are directed to release the eligible subsistence allowance to the writ petitioner.

4. With the above said observations, this Writ Petition stands disposed of. There shall be no order as to costs. Consequently connected Miscellaneous Petitions stand closed.
