PRAYER :- For Interstate Anticipatory Bail in Cr.No.1258 of 2025 on the file of the first respondent police.

ORDER : The Court made the following order :- The petitioner, who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 318(4), 316(2), 319, 3(5) of BNS, 2023, in Cr.No.1258 of 2025 on the file of the respondent police, seeks interstate anticipatory bail.

2. The case of the prosecution is that the petitioner is a Director of a company, viz., ASV Import and Export Ltd, Tanzania and the petitioner purchased the goods from the complainant on credit basis. After receipt of consignment, the petitioner failed to pay the sale consideration and thereby, cheated the complainant. Hence the case.

3. Learned counsel appearing for the petitioner would submit that the petitioner has nothing to do with the aforesaid alleged offence and a false case has been foisted against him. There is no specific role played by the petitioner. The petitioner is now taking steps to file anticipatory bail before 2/5

the Court at Pune. Hence, prayed to grant inter state anticipatory bail to the petitioner.

4. Though notice has been served on the second respondent, none has entered appearance. The learned Counsel for State of TN (Crl.Side) appearing for the 1st respondent objected to grant anticipatory bail.

5. The learned counsel for the intervenor seeks time to file intervene petitione and strongly opposed to grant anticipatory bail on the ground that the petitioner cheated a sum of Rs.1,69,87,000/-.

Taking into consideration the facts and circumstances of the case, considering the nature of offences and the petitioner has to take steps for bail and he has to go to Mumbai, this Court is inclined to grant inter-state interim anticipatory bail to the petitioner for a period of six weeks to enable him to move the concerned Court.

7. Accordingly, interim interstate anticipatory bail is granted to the petitioner for a period of six weeks, on condition that the petitioner shall surrender before the learned Judicial Magistrate, Alangudi, within a 3/5

period of fifteen days from the date on which the order copy is made ready and the petitioner shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the said learned Magistrate. Further, within four weeks from the date of execution of bail bond, the petitioner shall approach the competent Court and seek appropriate relief.
