ORDER : The Court Made the following order :- The petitioner is in judicial custody since 03.09.2018 for the offences punishable under Sections 147, 148, 448, 294(b), 307 and 506 (ii) I.P.C. in Crime No.30 of 2018, on the file of the respondent Police. The petitioner is arrayed as Accused No.3. He seeks bail.
2.Heard the learned counsel appearing for the petitioner and the learned Additional Government Pleader appearing for the respondent.
3.The case of the prosecution is that due to previous enmity between the petitioner and the de-facto complainant on 02.09.2018, when the de-facto complainant was standing in the occurrence place, the petitioner along with other accused persons attacked the defacto complainant by using deadly weapons and also scolded him with filthy language. Hence the complaint,.
4.The learned counsel appearing for the petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in this case.
5.The learned Additional Public Prosecutor appearing for the respondent would submit that there are totally six accused in this case and the petitioner is the third accused. https://hcservices.ecourts.gov.in/hcservices/
6.Considering the above facts and circumstances and also considering the period of incarceration undergone by the petitioner, this Court is inclined to grant bail to the petitioner. Accordingly, the petitioner is ordered to be released on bail subject to the following conditions:
(i) the petitioner shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties, each for a like sum to the satisfaction of the learned Judicial Magistrate, Srivaikundam.
(ii)the petitioner shall appear before the respondent police daily at 10.30 a.m. until further orders;
