Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, to direct the respondents to measure petitioner's Nanja land in survey numbers 104/ 10, 104/ 11B measuring an extent of 86 cent based on his application dated 03.11.2014 and based on 26.11.2016 representation within the stipulated time fixed by this Hon'ble Court.

The petitioner seeks for a direction to the respondents to measure the land at survey Nos.104/ 10, 104/ 11B measuring an extent of 86 cents based on his application, dated 03.11.2014 followed by a reminder dated 26.11.2016.

2.The case of the petitioner is that even though application to measure the land has been given by paying necessary fees, the respondents have not taken steps to measure the land. Needless to say that it is for the respondents to consider the application of the petitioner and pass appropriate orders on merits and in accordance with law also after giving an opportunity of hearing to the rival claimants, if any. Such exercise shall be done by the respondents within a period of eight weeks from the date of receipt of a copy of this order. It is made clear that this Court, https://hcservices.ecourts.gov.in/hcservices/

at this stage, is not expressing any view on the claim made by the petitioner, as it is for the respondents to consider and pass orders as stated supra.

3.With the above directions, the writ petition is disposed of. No costs.
