Prayer : Review Application filed under Order 47 Rules 1 and 2 read with Section 114 of the Civil Procedure Code, to review the order dated 26.02.2024 made in W.A(MD)No.168 of 2024 passed by this Court against the order in W.P(MD)No.23421 of 2023 dated 01.11.2023 and consequently grant the reliefs as prayed for by the review applicant/appellant/petitioner in the above writ petition in W.P(MD)No.23421 of 2023 by allowing this review application.

ORDER

(Order of the Court was made by R.SUBRAMANIAN, J.) The petitioner questioned the order of transfer from Madurai Mofussil Branch to Thirupuvanam Branch claiming that the same was punitive in nature. The Writ Court found that the claim of the petitioner that it is punitive in nature, has not been made out and dismissed the writ petition. Aggrieved, the petitioner preferred an appeal in W.A(MD)No.168 of 2024 and a Division Bench also concurred with the learned Single Judge and dismissed the appeal. The claim of the petitioner that there are no basic facilities in Thirupuvanam Branch and the Buses are not in good condition, was also considered and the Division Bench directed the appellant to make a representation to the department in that regard. Though the review petitioner / appellant would reiterate the claims that he made before the learned Single Page No.2 of 4

Judge and the Division Bench, the scope of review being very limited, we are unable to entertain the review petition.

Hence, this Review Petition is dismissed. This will not, however, preclude the appellant from making a request for transfer to some other Branch and the respondents will consider such request without being influenced by any of the observations made in this order. No costs. Consequently, connected miscellaneous petition is closed.
