PRAYER :- For Bail in Crime No.76/2023 on the file of the Respondent Police.
ORDER : The Court made the following order :- The petitioner/accused No.5, who was arrested and remanded to judicial custody on 16.05.2023 for the offences under Sections 294 (b), 450, 297, 506(ii) of I.P.C and Section 3(i) of TNPPDL Act in Crime No.76 of 2023 on the file of the respondent Police, seeks bail.
2.The case of the prosecution is that the petitioner along with other accused illegally trespassed into the Tasmac shop and assaulted the staff and took a sum of Rs.6,47,760/-, 4-gram gold ring and mobile phone worth about Rs.5,000/- and also caused damage to the CCTV camera. Hence, the complaint.
3.The learned counsel appearing for the petitioner would submit that the petitioner is having immovable properties in his own name and he will not abscond or tamper with the witness and he is ready to cooperate with the prosecution and prayed for granting bail to the petitioner.
4.The learned Additional Public Prosecutor appearing for the respondent would submit that this is the second application filed by the petitioner and earlier, the petitioner filed Crl.O.P. (MD)No.10504 of 2023, wherein, this Court dismissed the petition on 14.06.2023 and there is no change in circumstances and hence, he opposed for granting bail to the petitioner.
5.Taking note of the facts and circumstances of the case and also taking into consideration that there is no change in circumstances, this Court is not inclined to grant bail to the petitioner.
6.Accordingly, this Criminal Original Petition is dismissed.
