PRAYER :- Writ Petition is filed under Article 226 of the Constitution of India, for issuance of a Writ of Mandamus directing the 1st respondent to dispose the statutory appeal filed on 07.03.2024 by the petitioner by condoning the delay within a time stipulated by this Court. Heard Mr.T.S.Mohamed Mohideen, learned counsel appearing for the petitioner and Mr.K.S.Selvaganesah, learned Additional Government Pleader appearing for the respondents.

2. This Writ Petition has been filed seeking to issue direction to the 1st respondent to dispose the statutory appeal filed on 07.03.2024 by the petitioner by condoning the delay within a time stipulated by this Court.

3. The petitioner, who is working as a Senior Clerk has been dismissed from service has filed an statutory appeal before the first respondent along with a petition to condone the delay in filing the appeal. Now the petitioner has filed this writ petition to direct the first respondent to dispose the statutory appeal filed by the petitioner by condoning the delay petition.

4.Since the first respondent / appellate authority has not passed any orders either in the condone delay petition in preferring an appeal or in the appeal, I feel it is appropriate to direct the first respondent to consider the appeal filed by the petitioner in the interest of justice and pass orders on merits in the appeal also within a period of six weeks from the date of receipt of copy of this order.
