R.Srinivasan :Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Declaration, to declare the registration of the deed of Revocation of the gift deed dated 12.01.2009 registered as Doc.No.58/2009 on the file of the third respondent in respect of the property bearing Town Survey No.149 in an extent of 595 Sq.ft situated in Ward No.32-A, Glasskara Street, Madurai-1 as illegal and against the provisions of the Registration Act.

ORDER

A gift settlement deed registered in Doc.No.819/ 1999, dated 31.03.1999 before the Sub Registrar, Madurai came to be cancelled through a deed of revocation of the gift deed registered as Doc.No.58 of 2009, dated 12.01.2009. Challenging the registration of the deed of revocation, the present writ petition has been filed. https://hcservices.ecourts.gov.in/hcservices/

2.By consent of both parties, this writ petition is taken up for final disposal at the stage of admission itself. 3.Pending the writ petition, the first petitioner and the fourth respondent herein had entered in to a joint compromise memo dated 11.12.2017, whereby the petitioner and the fourth respondent herein have agreed to the effect that the property in Survey No.149 in Ward No.32A Glasskara Steet, Madurai-1 will be under the joint possession and enjoyment of the petitioner and the fourth respondent during their life time and thereafter, the ownership shall be passed to their children namely, S.Karthiga Devi and S.Sudharsan. As such, cancellation of the deed of revocation may not be warranted.

4.In view of the same, there is no necessity for passing any orders in the present writ petition. Accordingly, the Writ Petition stands closed. No costs. Consequently, connected Miscellaneous Petitions are also closed.
