Respondents PRAYER: Petition is filed under Article 226 of the Constitution of India, to issue a writ of Mandamus forbearing the 1st respondent from in anyway consider and disburse the insurance amount to the 4th respondent, in view of the referred charge sheet filed by the 2nd respondent in Cr.No.159/2016 and consequently direct the 1st respondent to enquire the above said matter properly by appointing an investigator attached to the 1st respondent and disburse the applicable insurance amount to the petitioner by considering the representation given by the petitioner dated 01.05.2017 within the period stipulated by this Court.

The petitioner seeks for a Writ of Mandamus forbearing the 1st respondent from in anyway consider and disburse the insurance amount to the 4th respondent, in view of the referred charge sheet filed by the 2nd respondent in Cr.No.159/2016 and consequently direct the 1st respondent to enquire the above said matter properly https://hcservices.ecourts.gov.in/hcservices/

by appointing an investigator attached to the 1st respondent and disburse the applicable insurance amount to the petitioner by considering the representation given by him on 01.05.2017. 2.The learned Additional Government Pleader takes notice for the respondents 1 & 2. By consent, the writ petition itself is taken up for final disposal.

3.The learned counsel for the petitioner submitted that it would suffice if the representation of the petitioner is directed to be disposed of, on merits and in accordance with law, within a time frame to be fixed by this Court.

4.In view of the limited scope of the prayer, without going into the merits of the matter, respondents are directed to consider and dispose of the representation of the petitioner, dated 01.05.2017, on merits and in accordance with law, within a period of four weeks from the date of receipt of a copy of this order, after providing an opportunity of personal hearing to the petitioner.

5.With the above direction, the Writ Petition stands disposed of. Consequently, connected Miscellaneous Petition is closed. No costs.
