The writ petition has been filed for issuance of a Writ of Mandamus, directing the respondent to grant permission and protection for children Cultural Program scheduled to be held on 29.10.2016 at 07.00 a.m., to 08.00 p.m., in connection with "Deepavali Festival" at Meenakshi Nagar, Irulappapuram, Kottar Post, Nagercoil, Kanyakumari District by considering the petitioner's representation dated 10.10.2016. 2.Mr.K.P.Krishna Doss, learned Government Advocate, takes notice for the respondents. By consent, the writ petition itself is taken up for final disposal.
3.The learned Government Advocate would submit that a proceedings under Section 107 of Cr.P.C., has been initiated against the petitioners' party as well as opposite party based on the complaint of the second respondent.
4.The learned counsel for the petitioner would submit that proceedings under Section 107 Cr.P.C., was already closed by the Revenue Divisional Officer, dated 10.08.2016. https://hcservices.ecourts.gov.in/hcservices/
5.Heard the learned counsel appearing for the petitioner and the learned Government Advocate appearing for the respondent and also perused the materials on record.
6. Though the petitioner has prayed for a relief of mandamus directing the respondents to grant permission and protection for children cultural program scheduled to be held on 29.10.2016, the learned counsel for the petitioner would submit that it would suffice to issue direction to the second respondent to consider the representation of the petitioner, dated 10.10.2016.
7.Considering the submissions made by the learned counsel for the petitioner, the second respondent is directed to dispose of the petitioner's representation, dated 10.10.2016 and pass orders on merits and in accordance with law on or before 26.10.2016.
8.Accordingly, the writ petition is disposed of. No costs.
