P4/29376/2021, dated 14.10.2022 on the file of the first respondent and quash the same as illegal and consequently, direct the first respondent grant patta in the petitioner's name as in respect of the property comprised in Survey No.107/7, 108/5 and 108/10 situated at Keeladi Village, Thirupuvanam Taluk, Sivagangai District. An order dated 14.10.2022 of the District Revenue Officer is the subject of challenge in this Writ Petition.
2. Learned counsel for the petitioner invited my attention to the impugned order and pointed out that the District Revenue Officer acknowledged that an error was committed during the UDR. Learned counsel further submits that the impugned order was passed on the basis that the petitioner failed to produce any documents relating to the death of Nonjaan Ambalam and the legal heirs of the said individual. By relying on a partition deed dated 06.04.1966, learned counsel contends that the property forming the subject of proceedings was item No.4 in such partition deed and that the said property was allotted to the share of the petitioner's vendor, Karuppaiya, under the partition deed. Therefore, he submits that the matter may be remanded for reconsideration by the District Revenue Officer.
3. Learned counsel for respondents 5 and 8 to 12 refutes these 3/6
contentions. He submits that the admitted case is that the petitioner was not in possession of the property for about 54 years. He also seeks to rely upon a document from the pre-UDR showing the names of respondents 8 to 12's father in this settlement 'A' register. Learned counsel concedes that this document was also not placed before the District Revenue Officer. Nonetheless, he opposes the remand by relying on the plaint in O.S.No.60 of 2025. He points out that this suit has been filed by the legal heirs of Karuppaiya seeking a declaration in relation to the same properties forming the subject of these proceedings.
4. Learned Government Advocate also submits that the District Revenue Officer would not be in a position to pass orders even on remand in view of the pending civil suit.
5. As noticed above, in the pending civil suit, the legal heirs of the petitioner's vendor have sought a declaration of title in relation to the same property. In these circumstances, remand, at this juncture, will not serve any purpose. Instead, this Writ Petition is disposed of by granting leave to the petitioner and the private respondents to reapply to the 4/6
District Revenue Officer after the civil suit is disposed of, depending on the verdict in such suit. Meanwhile, the Tahsildar is directed to not make any further mutations in relation to the relevant survey numbers. No costs. Consequently, connected miscellaneous petitions are closed.
