This writ petition has been filed, seeking a direction to the first respondent to dispose of the petitioner's appeal dated 22.12.2008, pending before the first respondent. 2.Heard the learned counsel for the petitioner and the learned Additional Government Pleader, who takes notice for the respondents. By consent, this writ petition itself is taken up for final disposal at the stage of admission.
3.The petitioner who is a village Assistant, suffered punishment of stoppage of increment for three years with cumulative effect, by virtue of the order passed by the second respondent dated 05.11.2008 and the same is challenged before the first respondent by filing the appeal dated 22.12.2008. https://hcservices.ecourts.gov.in/hcservices/
4.The learned counsel for the petitioner submitted that the petitioner is nearing superannuation in the month of May 2017 and therefore, it is all the more necessary that the appeal should be disposed of within the limited time frame.
5.It is also brought to the notice of this Court that the charge was in respect of bogus patta allegedly issued at the instance of the Village Assistant by the Tahsildar, but the patta issued has been held to be valid. Under such circumstances, this writ of mandamus seeking a direction to dispose of the appeal dated 22.12.2008 has been filed.
6.Considering the above stated circumstances, the first respondent is directed to dispose of the appeal within a period of six weeks from the date of receipt of a copy of this order. 7.The Writ petition is disposed of with the above direction. No costs.
