ORDER

The present Writ Petition has been filed for the issuance of a Writ of Certiorarified Mandamus, to quash the check slip dated 13.06.2025 and consequently direct the respondent to register the sale deed dated 13.06.2025. 1/4

Through the impugned order, the respondent has stated that in S.No.96 several lands were sold as housing plots and even in the Encumbrance Certificate it reveals various subdivisions as house sites. But the petitioner is registering the land as agriculture land, which is contradictory to earlier sale deed in S.No.96. Therefore, the respondent has refused to register the sale deed.

On perusal of the proposed sale deed, it is evident that the land in question was purchased as agricultural land, and there is no intention to develop the properties into a layout, as the land remains agricultural. Therefore, the respondent passed the impugned order without proper application of mind.

4. Accordingly, this writ petition is allowed and the impugned check slip dated 13.06.2025 issued by the respondent is hereby quashed. The respondent is directed to register the same within a period of four weeks, from the date of receipt of a copy of the order.
