Prayer : Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure, to direct the 2nd respondent police herein not to harass the petitioners under the guise of enquiry by the complaint lodged by the 3rd respondent one named Vennila on the basis of the petitioner's representation.

O R D E R

The petitioners with an allegation that the respondent police is harassing them under the guise of an enquiry have approached this Court.

2.Mr.P.Kottaichamy, learned Government Advocate (Crl.side) takes notice for the respondents 1 & 2 and submits that the first petitioner has lodged a complaint as against her daughter-in-law/the third respondent herein, through a registered post on 16.07.2024. The complaint received by the Commissioner of Police has been forwarded to the respondent police for conducting an enquiry and the respondent police has summoned the petitioner, however, the petitioner has not appeared before the respondent police.

3.The learned counsel appearing for the petitioners submits that the first petitioner's son died in an accident. Therefore, the first petitioner along with her daughter/the second petitioner has lodged a complaint as against the third respondent that she has attempted to evict them from their house. With regard to the dispute, the petitioners have 2/5

filed a suit in O.S.No.203 of 2024, before the Principal District Court, Madurai and the same is still pending.

4.This Court considered the rival submissions made. 5.According to the learned Government Advocate (Crl.side), the petitioners have lodged a complaint as against the third respondent. It is also reported that a civil suit in O.S.No.203 of 2024 is pending before the Principal District Court, Madurai. Therefore, the petitioners have to work out their remedy in the civil suit. Accordingly, this Criminal Original Petition is closed.
