The petitioner/the defacto complainant has approached this Court, seeking a direction to the respondent police to file a final report in 1/5
Crime No.70 of 2020, on the file of the respondent police. 2.The learned counsel appearing for the petitioner submits that some unknown persons have stolen 7 3⁄4 sovereigns of gold jewel and Rs.2000/- cash from her house in the month of March 2020, for which, she has lodged a complaint before the respondent police and the same was registered in Crime No.70 of 2020 on 22.03.2020 for the offence under Sections 457 and 380 of IPC. The grievance of the petitioner is that though the case was registered in the year 2020, there is no progress in the investigation.
3.Mr.P.Kottaichamy, learned Government Advocate (Crl.side) takes notice for the respondent and submits that the Investigating Agency has examined six witnesses so far, however, they are not in a position to fix the accused.
4.This Court considered the rival submissions made. 5.The case has been registered in the month of March 2020. It appears that the respondent police is not in a position to find out the 2/5
culprit in this case. Therefore, the Superintendent of Police, Madurai is directed to withdraw the case from the file of the respondent police and to entrust the same to some other sincere officer. The Superintendent of Police shall ensure that the final report is filed within a reasonable time. 6.With the above directions, this Criminal Original Petition is disposed of.
