PRAYER: Criminal Original Petition is filed under Section 482 of Cr.P.C., to direct the learned Principal District and Sessions Judge (PCR Court) Cases, Dindigul District to grant bail to the petitioner on the very same day of his surrender in connection with the case in Crime No.128 of 2019 on the file of the second respondent police. ORDER
This petition has been filed to direct the learned Principal District and Sessions Judge (PCR Court) Cases, Dindigul District to grant bail to the petitioner on the very same day of his surrender in connection with the case in Crime No.128 of 2019 pending on the file of the second respondent police.
2. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.Side) appearing for the official respondents. Considering the nature of the order going to be passed in this petition, notice to the third respondent is dispensed with.
3. Earlier this Court in Crl.O.P.(MD)No.5780 of 2019 by order https://hcservices.ecourts.gov.in/hcservices/ 1/2
Crl.O.P.(MD)No.11074 of 2019 dated 23.04.2019 directed the petitioner to surrender before the trial Court within a period of ten days from the date of receipt of a copy of that order. Since the petitioner could not arrange for sureties within the time stipulated, he filed an application seeking extension of time and this Court has also extended the time for surrender vide order dated 20.06.2019. The petitioner, without appearing before the learned trial Judge even after obtaining time extension, has filed the present petition seeking further extension of time only to delay the proceedings. Hence, this Court is not inclined to entertain this petition. Accordingly this Criminal Original Petition is dismissed.
