ORDER : The Court Made the following order :- The petitioner is in judicial custody since 23.09.2018 for the offences punishable under Sections 147, 148, 294(b), 352 and 506 (ii) I.P.C. and Section 3(1) of TNPPDL Act in Crime No.413 of 2018, on the file of the respondent Police. He seeks bail. 2.Heard the learned counsel appearing for the petitioner and the learned Additional Government Pleader appearing for the respondent.
3.The case of the prosecution is that on 13.09.2018, the petitioner along with other persons damaged the shop belonged to the de-facto complainant and also scolded him with filthy language and assaulted the de-facto complainant with deadly weapons. Hence the complaint.
4.The learned counsel appearing for the petitioner would submit that the petitioner was not participated in the said occurrence. The petitioner has been falsely implicated in this case. 5.Considering the above facts and circumstances and also considering the period of incarceration undergone by the petitioner, this Court is inclined to grant bail to the petitioner on condition that the petitioner shall deposit a sum of Rs.5,000/- to the credit https://hcservices.ecourts.gov.in/hcservices/
of Crime No.413 of 2018, before the concerned Judicial Magistrate. Accordingly, the petitioner is ordered to be released on bail subject to the following conditions:
(i) the petitioner shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties, each for a like sum to the satisfaction of the learned Judicial Magistrate, Shencottah, Tirunelveli District.
(ii)the petitioner shall appear before the respondent police as and when required for interrogation.
