Respondents PRAYER: Petition is filed under Article 226 of the Constitution of India, to issue a writ of mandamus, to direct the respondents 1 to 3 to conduct enquiry and take penal and other appropriate action against the 5th respondent under Tamil Nadu Co-operative Societies Act, in view of representation of the petitioner dated 29.04.2017, consequently, direct the respondents 1 to 4 to keep away the 5th respondent from the management and financial affairs of the 0.70 Pazhavoor Primary Agricultural Co-operative Credit Society Limited, Pazhavoor, Radhapuram Taluk, Tirunelveli District, till the completion of the enquiry to be conducted against the 5th respondent for having committed impersonation as P.Kumaresan. The petitioner seeks for a Writ of Mandamus to direct the respondents 1 to 3 to conduct enquiry and take penal and other appropriate action against the 5th respondent under Tamil Nadu Cooperative Societies Act, in view of the representation of the petitioner dated 29.04.2017, consequently, direct the respondents 1 to 4 to keep away the 5th respondent from the management and financial affairs of the 0.70 Pazhavoor Primary Agricultural Cooperative Credit Society Limited, Pazhavoor, Radhapuram Taluk, Tirunelveli District, till the completion of the enquiry to be conducted against the 5th respondent for having committed impersonation as P.Kumaresan.
2. The learned Government Advocate takes notice for R1 to R3. By consent, the writ petition itself is taken up for final disposal.
3. The learned counsel for the petitioner submitted that it would suffice if the representation of the petitioner is directed to be disposed of, on merits and in accordance with law, within a time frame to be fixed by this Court.
4. In view of the limited scope of the prayer, without going into the merits of the matter, the second and fourth respondents are directed to consider the petitioner's representation dated 25.04.2017 on merits and in accordance with law after providing an opportunity of personal hearing to the petitioner as well as the other parties concerned, if any, and pass appropriate orders within a period of eight weeks from the date of receipt of a copy of this order.
5. With the above direction, the Writ Petition stands disposed of. No costs. Consequently, the connected miscellaneous petition is also closed.
