For Respondent : Ms.Anantha Devi, Government Advocate (Crl.Side) PETITION FOR MODIFICATION UNDER SECTION 439(i)(b) of Cr.P.C PRAYER :- To modify the one impugned condition of shall deposit Rs.15,000/- (Fifteen thousand Rupees) in bail order on the file of the Principal Sessions Judge, Sivagangai in Cr.M.P.No.1750 of 2019 dated 29.07.2019 ORDER : The Court Made the following order :- This petition has been filed to modify the condition imposed by the learned District and Sessions Judge, Sivagangai in Crl.M.P.No.1750 of 2019 dated 29.07.2019, directing the petitioner to deposit a sum of Rs.15,000/-before the learned Additional District Munsif cum Judicial Magistrate, Manamadurai.

2. The learned counsel for the petitioner would submit that the petitioner was granted bail by the learned District and Sessions Judge, Sivagangai in Crl.M.P.No.1750 of 2019 dated 29.07.2019 with a https://hcservices.ecourts.gov.in/hcservices/

condition to deposit a sum of Rs.15,000/-before the learned Additional District Munsif cum Judicial Magistrate, Manamadurai. He would further submit that since the petitioner is in custody he is not able to mobilize the fund and deposit the said amount as per the direction issued by the Sessions Court.

3. The learned Government Advocate(Crl.Side) did not raise any objection for modifying the said condition.

4. Considering the submissions made by the learned counsel for the petitioner, the condition imposed by the learned District and Sessions Judge, Sivagangai in Crl.M.P.No.1750 of 2019 dated 29.07.2019, directing the petitioner to deposit a sum of Rs.15,000/-before the learned Additional District Munsif cum Judicial Magistrate, Manamadurai is alone setaside.
