Respondents Prayer: Writ Petition is filed under Article 226 of the Constitution of India for issuance of a writ of Mandamus, directing the first respondent to consider the representation of the petitioner dated 21.05.2017 and to direct him to grant an emergency leave of 5 days to petitioner's younger brother viz., Manikandan @ Nagendra Bhoopathi aged 39 years undergoing life sentence in Central Prison, Madurai.

It is seen that the petitioner's brother K.Manikandan @ Nagendra Bhoopathi is life convict undergoing life sentence in the Central Prison, Madurai and that his mother Kaliammal is under very critical medical conditions and counting her days as bedridden, for which, he is seeking leave under the provisions of the Tamil Nadu Suspension of Sentence Rules, 1982. Under the said Rules, emergency leave can be granted by the Superintendent of Central Prison itself.

3. Be that as it may, without going into the legality, this Court directs the Superintendent of Prison, Central Prison, Madurai to send the life convict under the police escort to see his mother for three days ie., on 12.06.2017 and he brought back on 15.06.2017 at 6.30 a.m.
