PRAYER: Petition filed under Section 482 Code of Criminal Procedure, to direct the third respondent not to interefere with the civil rights of the petitioner possession and enjoyment of the property comprised in survey No.299/2-B vide Patta No. 1243 situated at Nadumandalam Village, Natham Taluk, Dindigul. O R D E R

This Petition has been filed seeking direction to the third respondent not to interefere with the civil rights of the petitioner possession and enjoyment of the property comprised in survey No.299/2-B vide Patta No. 1243 situated at Nadumandalam Village, Natham Taluk, Dindigul.

2. Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondent police.

3. The learned counsel appearing for the petitioner would state that civil dispute is pending between the parties and the fourth respondent herein is a Police Constable and he has interfered with the peaceful enjoyment and possession of the defacto complainant.

4. The learned Additional Public Prosecutor (Crl.Side) appearing for the respondent police, on instructions, would state that the petitioner herein is brother of the third respondent and earlier, there was a complaint and the complaint was enquired and closed on 17.05.2018. He further would state that as on date there is no complaint against the petitioner.

5. Recording the aforesaid submission, the Criminal Original Petition stands closed.
